Refund Policy

By engaging with Elegance & Strength services, you agree to the following policies:

 Payments & Fees:
 • All payments are non-refundable.
 • A 50% deposit is required before work begins.
 • The remaining 50% balance is due before final deliverables, files, or access are provided.
 • For monthly retainers, a valid card must be kept on file for automatic billing.
 • For payment plans, a card must remain on file for scheduled payments.
 • No final files, assets, or website access will be released until the project is paid in full.
 • Failure to pay may result in suspension of services and legal recovery of fees.

Retainer Commitment:
 • Monthly retainers require a 6-month minimum commitment.
 • Hours are locked for the contract term. You may increase, but not decrease until after 6 months.
 • Unused hours are non-refundable and do not roll over.
 • A 30-day written notice is required to cancel after the initial term.

Hourly Rate & Additional Hours:
 • Standard rate: $150/hour.
 • Additional hours beyond your agreement are billed at this rate.
 • Clear communication will be provided before billing extra hours.

Project Pausing & Reactivation:
 • No communication for 15+ days = $150 reactivation fee.
 • No communication for 30+ days = project closed, work delivered as-is, no refunds.
 • Resuming after closure requires a new contract, subject to pricing changes.

Project Timeline:
 • Timely feedback and content submission are required to stay on schedule.
 • Delays caused by the client may result in extended timelines or additional fees

Final Deliverables:
 • Deliverables are released after full payment.
 • Client is responsible for third-party fees (Showit hosting, domain, email services).

Confidentiality & Usage Rights:
 • All content and designs belong to the client after full payment.
 • Elegance & Strength may display completed work in our portfolio or social media unless agreed otherwise in writing.

Legal Protection Additions:

Intellectual Property Rights:
 • All designs, strategies, and materials remain the intellectual property of Elegance & Strength until fully paid.
 • Unauthorized reproduction or resale of materials is prohibited.
 • Client must own or have rights to all materials they provide. We are not liable for copyright issues on client content.

 Limitation of Liability:
 • Elegance & Strength is not liable for indirect, incidental, or consequential damages.
 • Not responsible for delays caused by third-party platforms or events beyond control.
 • Maximum liability shall not exceed the fees paid by the client.

Force Majeure:
 • We are not liable for delays or failure to perform due to acts of God, war, pandemics, government actions, natural disasters, or unforeseen events.

Governing Law:
 • These Terms are governed by the laws of the State of Idaho.

Dispute Resolution:
 • Disputes will first be addressed through good faith negotiation.
 • If unresolved, parties agree to mediation before legal action.
 • Any legal matters shall be brought in Eagle, Idaho, under Idaho jurisdiction.
